1. Introduction

These terms and conditions govern the affiliate program of Sinister Fish Games LTD, a company registered in England & Wales with a registered address at Sparkhouse, Ropewalk, Lincoln, LN6 7DQ, United Kingdom. By participating in the affiliate program, you agree to abide by these terms and conditions.

2. Definitions

• “Affiliate” refers to an individual or entity that has registered and been accepted into the affiliate program.
• “Commission” refers to the monetary reward paid to the Affiliate for successful referrals.
• “Referral” refers to a customer who has made a purchase through the Affiliate’s unique referral link.

3. Registration and Approval

• Affiliates must complete the registration process and be approved by Sinister Fish Games LTD.
• Sinister Fish Games LTD reserves the right to reject any application at its sole discretion.

4. Obligations of the Affiliate

• Affiliates must comply with all applicable laws and regulations.
• Affiliates must not engage in any deceptive, misleading, or unethical practices.
• Affiliates must clearly state “Sponsored link” along with any content using an affiliate URL.

5. Commissions

• Commission rate is 8% of the total price paid by the customer, not including shipping fees.
• Commissions will be paid on a [quarterly] basis.
• Commissions will be calculated based on the sales value of referred customers.
• Sinister Fish Games LTD reserves the right to withhold commissions in cases of suspected fraudulent activity.

6. Intellectual Property

• Affiliates are granted a non-exclusive, revocable license to use Sinister Fish Games LTD’s trademarks and marketing materials for the purpose of promoting the affiliate program.
• Affiliates must not alter or modify these materials without written consent from Sinister Fish Games LTD.

7. Termination

• Either party may terminate this agreement with written notice.
• Sinister Fish Games LTD may terminate the agreement immediately if the Affiliate is found to be in breach of these terms.

8. Liability and Indemnification

• Sinister Fish Games LTD will not be liable for any indirect, special, or consequential damages arising out of this agreement.
• The Affiliate agrees to indemnify Sinister Fish Games LTD against any claims, damages, or legal expenses arising from the Affiliate’s breach of these terms.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the United Kingdom, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
